Terms and Conditions for ProAct

Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the ProAct mobile application (the "App") and related services operated by ProAct ("we," "our," or "us").

By accessing or using ProAct, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

• You must be 18 years or older to use ProAct
• Individuals under 18 are strictly prohibited from using the App
• You represent that you have the legal capacity to enter into these Terms

2. Description of Service

ProAct provides access to publicly available safety-related data, including offender registry information, and tools to:

• View location-based safety information
• Monitor locations
• Generate and share safety reports
• Compare images against publicly available records

ProAct is provided for informational purposes only.

3. No Harassment or Misuse

You agree not to use ProAct for harassment, intimidation, or targeting of any individual.

Prohibited behavior includes, but is not limited to:

• Harassing or threatening any person
• Attempting to locate individuals for unlawful purposes
• Encouraging others to engage in harassment or violence

Violation of this section may result in:

• Immediate account termination
• Suspension of access
• Cooperation with law enforcement and state prosecutors at our discretion

4. Data Accuracy and Source Disclaimer

ProAct aggregates data from publicly available sources, including state and federal government registries.

You acknowledge and agree that:

• All data is provided by third-party government sources
• Data may be incomplete, outdated, or incorrect
• ProAct does not verify or guarantee the accuracy of this information

You should rely on official government sources for authoritative information.

5. No Liability for Use of Data

To the fullest extent permitted by law:

• ProAct is not responsible for how you use the data provided through the App
• ProAct is not responsible for any actions taken based on the data
• ProAct is not responsible for how other users or third parties use the data

You assume all risk associated with your use of the App and its content.

6. No Liability for Third-Party Conduct

ProAct is not liable for:

• Actions of other users
• Actions of third parties who receive shared reports
• Any misuse, redistribution, or interpretation of data by others

7. Restrictions on Data Use and Access

You agree not to:

• Crawl, scrape, or harvest data from the App
• Use bots, scripts, or automated systems to access the App
• Copy, download, or reproduce large portions of data
• Extract or reuse photos, images, or datasets from ProAct
• Reverse engineer or attempt to replicate the service

We reserve the right to block or restrict access for any such activity.

8. User Content and Sharing

If you share reports or upload content:

• You are responsible for your use of that content
• You agree not to share content in a way that violates laws or these Terms

We are not responsible for how recipients use shared information.

9. Intellectual Property

All content, features, and functionality of ProAct (excluding public government data) are owned by ProAct and protected by applicable laws.

You may not:

• Copy or reproduce the App or its proprietary components
• Use ProAct branding without permission

10. Termination

We may suspend or terminate your access at any time, without notice, if you:

• Violate these Terms
• Engage in misuse or abuse of the platform
• Use the App in a way that creates legal or safety risk

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED
• WE DO NOT GUARANTEE ACCURACY, COMPLETENESS, OR RELIABILITY OF DATA
• WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

PROACT SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM USE OF THE APP
• DAMAGES RESULTING FROM RELIANCE ON DATA PROVIDED THROUGH THE APP

13. Indemnification

You agree to indemnify and hold harmless ProAct from any claims, damages, or liabilities arising from:

• Your use of the App
• Your violation of these Terms
• Your misuse of data or content

14. Arbitration and Class Action Waiver

Binding Arbitration

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or your use of ProAct shall be resolved exclusively through binding arbitration, rather than in court.

• Arbitration shall be conducted by a recognized arbitration provider (e.g., AAA or similar)
• The arbitration will be conducted on an individual basis
• The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this clause

Class Action Waiver

You agree that:

• You may bring claims only in your individual capacity
• You waive any right to participate in a class action, collective action, or representative proceeding

If this class action waiver is found unenforceable, the arbitration provision shall still apply to the fullest extent permitted by law.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.

16. Changes to Terms

We may update these Terms at any time. Continued use of the App constitutes acceptance of the updated Terms.
